1.Service Provider Details

2. General rules

 

2.1 These General Terms and Conditions govern the use of the Service Provider's premises and their services.

2.2 Special, unique conditions are not part of the published General Conditions, but they do not exclude the conclusion of separate contracts with travel agents and organizers, sometimes with other conditions corresponding to the type of activity.

 

3. Contracting Party

 

3.1 The services provided by the Contractor are used by the Guest.

3.2 If the Guest places an order for services directly with the Contractor, then the Guest is a Contracting Party. The Service Provider and the Guest jointly become parties to the agreement (hereinafter referred to as the Parties) subject to the conditions.

3.3 If an order for services is submitted to the Contractor by a third party (hereinafter referred to as the Intermediary) on behalf of the Guest, the terms of cooperation are governed by an agreement concluded between the Contractor and the Intermediary. At the same time, the Contractor is not obliged to verify that the third party legally represents the Guest.

3.4 In the case of using a medical service, the Guest is obliged to inform the Provider about any health condition, and the Service Provider is obliged to pay attention to possible health risks.

 

4. Contractual relations

 

4.1 The Contractor sends an offer to the Guest upon an oral or written request for an offer.

Rooms are sold based on available occupancy and reservations are confirmed by the service provider in the order they are received.

4.2 The Contract is concluded by written confirmation of the Guest's booking sent by the Service Provider and is therefore considered a written Contract. An oral stipulation, agreement, amendment or verbal confirmation thereof by the Service Provider does not constitute a contract.

4.3 The content of the contract includes: subject, place, duration and cost of the service.

It also includes payment, cancellation and modification terms

4.4 To make changes and/or additions to the Agreement, a written agreement signed by the Parties is required.

 

5. Basic hotel services

 

5.1 Accommodation services Type of accommodation in Apartment:

5.1.1. Double apartment: bedroom with two single beds or a double bed, bathroom (sink, shower, toilet), kitchen, terrace.

 In some cases, the room is max.. Apartment area is 20-31 m2.

5.1.2. One-and-a-half apartment: Duplex (living room and bedroom), double bed, extra bed, bathroom (sink, shower, toilet), terrace. Room area 28 m2 + terrace

 

5.1.3. One-and-a-half apartment: Duplex (living room and bedroom), double bed, extra bed, bathroom (sink, shower, toilet), terrace. Room area 35 m2 + terrace.

5.1.4. Basic room equipment: LED TV, safe, hairdryer, towel, bathrobe for adults, WIFI connection. All rooms are non-smoking.

5.2. Hospitality

5.2.1. The apartment does not provide breakfast for its guests

5.2.2. It is possible to meet individual needs based on preliminary consultation

 

 

6. Prices

 

6.1 The cost of a room in the Apartment (M&M Apartment Budapest House) is indicated on the website.

M&M Apartment Budapest House is free to change its advertised prices without prior notice unless it commits itself to a specific period.

6.4 Prices include the value added tax (VAT) rate in force at the time of offer, as regulated by law. M&M Apartment Budapest House will pass on to the Contracting Party any additional costs due to changes in applicable tax laws (VAT) subject to prior notice.

6.5 Tourist tax is paid in addition to the cost of accommodation.

6.6 Information about current discounts, promotions and other offers is posted on the website.

 

7. Terms of payment

 

7.1 We request that 100% of the total amount of the hotel stay be paid by bank transfer at the time of confirmation sent by the Service Provider and a copy of the booking payment voucher (name, address, booking number or, if necessary, an invoice with VAT number and address issue) send to the Service Provide

7.2 If 14-8 days pass between booking and check-in, please pay the full amount.

7.3 If 7 days or less elapse between booking and arrival, the guest will pay the full amount.

7.4 In case of special offers, payment terms may change and this will be stated in the written confirmation.

7.5 In case of non-payment, the room reservation is automatically cancelled.

7.6 Accepted payment methods: bank transfer, bank card, cash.

7.7 Costs associated with the use of any payment method are borne by the Contracting Party. Travel agencies / tour operators / OTAs / cooperation partners: the contract with the service provider contains individual payment terms.

7.8 Gift Voucher: A Gift Voucher can only be used for the validity period and value stated on it, subject to availability. The full value of the Voucher must be paid in advance. After the redemption period, the voucher becomes invalid.

 

8. Cancellation Conditions

 

8.1 Cancellation of an order must always be made in writing.

8.2. (a) The guest (customer) may cancel the reservation free of charge if he/she informs the apartment of his/her intention to cancel the reservation in writing no later than 21 days prior to arrival.

 

The cancellation fee, due within 20 days of arrival, is 100% of the booking price.

 

8.3. If the Contracting Party has secured the use of accommodation services by paying for the reservation, guaranteeing a credit card or otherwise provided for in the Agreement, and does not arrive before 23:30 local time on the day of arrival, or does not notify in advance, then the payment for accommodation for 3 days will later be applied as a penalty. In this case, accommodation will be reserved for the Contracting Party until 11:00 on the day following the day of arrival, after which the Contractor's obligation to provide services ceases.

8.4 Refunds of services (accommodation, meals, procedures, etc.) booked but not used or changed during the Guest’s stay at the hotel are not possible.

8.5 In the case of special bookings for products, group travel or events, the Service Provider may impose conditions different from the above, set out in a separate Agreement.

8.6 The conditions for cancellation by the Contracting Party are based on the current Government Decree (45/2014. (II.26)).

 

9. Method and terms of use of the service

 

9.1. The guest can book a room in the Apartment on the day of arrival no earlier than from 14:00 to 15:00, earlier check-in is possible by prior arrangement. If the room is occupied before 14:00, the Apartment has the right to charge an additional fee. From 1 September 2021 in Hungary, the accommodation provider must record the personal details of all guests, as defined by law, upon arrival using a document reader or manually, so you can only check in with a photo ID, with the exception of all children under the age of 14 years (Government 584/2021. (X 14.), from October 29, 2021 until the end of the emergency, data and document ID also do not need to be registered). According to the decree, personal data required by law (Law CLVI of 2016 on State Fees for the Development of Tourist Areas) can be recorded based on the application of a representative (e.g. parent, guardian) of the accommodation facility for guests under the age of 14.

In case of cancellation due to legal requirements (lack of certificate), the cancellation conditions specified in the confirmation will apply. Our guests receive their own room keys, which requires registration of the guest(s) staying in the room. Registration means correctly filling out the registration form and confirming the guest's identity. In the case of stateless persons and non-European Union citizens, the presentation and handover of an identity card or stateless passport is mandatory by law. By accepting the room code, the Guest agrees to the apartment policy. Reception opening hours: 00.00-24.00 The guest must leave the room with his luggage and belongings before 11:00 am on the last day of his stay. If the room is vacated later, the apartment has the right to charge an additional fee. If the room is not available by 2:00 pm on the day of departure, the full nightly rate will be charged. On the day of departure, it is possible to extend the stay for a fee if there are no guests in the room on that day. Before leaving your room, please ensure that your valuables and personal items are not left in the room.

9.2 If you wish to leave an already occupied accommodation before the time specified in your booking, you must pay a fee corresponding to the entire duration of the booking. Remuneration for accommodation in the apartment must be paid no later than before the final check-out from the hotel in the manner specified in the confirmation.

In case of refusal to pay for any reason, the apartments have the right to detain the guest's belongings brought to the apartment and exercise their right of lien on them.

In case of departure without payment, in addition to the police report, the apartment makes claims to the guest in court, the costs of which are borne by the guest. The amount of any subsequently incurred and unpaid fees will be debited from the guest's bank card by the apartment.

9.3. The apartment does not accept guests with infectious diseases.

9.4. Together with the completed and signed registration form, the Guest accepts and undertakes to comply with the General Terms and Conditions of M&M Apartment Budapest House. Information required during your stay can be found in the room folder in your confirmation email.

In addition, the apartment's online reception is available to guests 24 hours a day.

9.5. The Apartment is not responsible for injuries caused by the Guest. The Apartment may recover from the Guest the costs incurred in connection with the intentional infliction of damage.

9.6. Accepted means of payment, Bank card (AX, EC/MC, VI).

9.7. Guests under 18 years of age. Children under the age of 18 can live in the apartment only under the constant supervision of their parents or another person authorized by them. Those accompanying the child are responsible for the safety of the child and for any damage caused by the child. Guests under the age of 18 can use the services of the apartment only when accompanied by a parent or another legally authorized person authorized by him. Alcohol is not sold to persons under 18 years of age on site or at events.

9.8. Only registered guests can stay in the apartment rooms.

From 20:00 to 8:00, outside guests are only allowed in the common areas of the apartments. Guests are responsible for the conduct of their visitors, including any damages that may result. The apartment excludes liability for damage caused by the visitor to Guests and/or third parties. For a number of guests exceeding the number specified in the room reservation, the apartment will charge a fee in accordance with the current daily prices.

9.9. Pets: Pets are not allowed in the apartment.

9.10. Parking: Cars of apartment guests and event participants can be parked in the open parking lot near the apartment and on nearby streets for an additional fee. Parking spaces are not reserved.

9.11. WIFI The apartment has a WIFI system, the use of which is free.

Our guests will receive the WIFI password in their confirmation email. The apartment does not guarantee continuous, uninterrupted operation and availability of WIFI.

The apartment is not responsible for any direct or indirect damage caused to our guests' devices or their contents during or as a result of using WIFI. Our guests use the service at their own risk.

9.12. Daily cleaning: The apartment provides cleaned rooms with bed linen and towels. During the stay, the guest must request cleaning separately through the mobile app for an additional fee.

 

 

 

 

10. Nutrition

 

The room rate does not include breakfast.

10.1. Guests may bring and store food in the apartment without special permission.

10.2. Guests can prepare their own food at their own discretion.

The apartment rooms have a fully equipped kitchen with everything you need.

 

11. Safety

 

All our guests must comply with the fire safety rules of the apartment. In the event of a fire alarm, the building must be evacuated immediately, following the evacuation routes, taking care of each other's physical health! Fire extinguishers are located in the rooms and corridors of the apartment. In the event of a fire, our guests are required to immediately notify the online reception. The person who caused the damage or his legal representative bears financial responsibility for damage caused by the unreasonable use of manual fire alarm devices located in the apartment building.

It is prohibited to store flammable or explosive materials in the room, or to use your own coffee maker, water heater, iron or other electrical appliances. The apartment has the right to terminate the agreement for the provision of accommodation services with immediate effect.

11.1. Electronic surveillance system on the territory of the apartment Movement in the territory of the apartment and outside it is monitored using an electronic surveillance system (cameras), during which pictures are taken containing personal data. The camera system is controlled by the apartment. The purpose of surveillance and recording of images is to protect the life and physical integrity of persons located on the territory of the apartment, as well as the property used by the apartment. By entering and staying at the property, our guests consent to the management of data associated with the recording of images and acknowledge the provisions of the data management rules.

11.2. Illegal behavior. For the peace of mind of our guests on the territory of the apartment after 22:00 - with the exception of events organized or sanctioned by the apartment, in the case of a program - volume in the room, playing music, noisy events, sound effects, disturbing volume of TV, radio, etc. is prohibited. Within the premises of the apartment, regardless of the time, any conduct or conduct that disturbs the peace, security, sense of security and privacy of others is prohibited; is, or may be considered, harassment likely to intimidate others. An apartment employee has the right to warn a disturbing and/or loud guest. The first warning is free, for the second and third warnings the hotel charges 5,000 HUF each to the account of the number of the warned guest. After the third warning, the hotel has the right to unilaterally terminate the agreement with the apartment with immediate effect and immediately evict the guest from the apartment without any obligation for return and/or compensation. The apartment declines responsibility for any damage caused to other guests by the guest's behavior.

 

12. Hotel Tools and Equipment

 

Our guests are required to use the tools and equipment of the apartment for their intended purpose. Damage caused by improper use or additional cleaning must be compensated upon notification to the apartment, but no later than before departure. Furniture and equipment of the apartment are prohibited from being taken outside the territory of the apartment. Any rearrangement of the hotel room or rearrangement of furniture may only be carried out by the apartment staff or their authorized representative. Taking the apartment's property is considered a crime, in which case the apartment will take the necessary criminal and civil measures. Our guests are required to notify the apartment if any equipment, furniture or equipment of the hotel breaks down. Our guests do not have the right to correct the error themselves or attempt to correct it. The apartment is not responsible for any damages resulting from this. Reimbursement of the cost of repairs is the responsibility of the guest, the cost of which will be charged to the guest as evidenced by the apartment's invoice.

 

13. The following items are prohibited from being brought into the apartment:

 

• things classified by current legislation as corrosive and flammable chemicals or substances

• substances classified by current legislation as flammable and/or explosive substances,

• fireworks, firecrackers, their parts and components,

• waste, items harmful to the environment or health,

• psychotropic substances (narcotics),

• especially expensive, especially valuable valuables, museum items.

Upon prior written request of the guest, the apartment may authorize in writing the importation of items that cannot be brought into the apartment. If our guest brings something that cannot be brought onto the property without the prior written permission of the apartment, the apartment may remove it or have it removed at the guest's expense. The apartment declines responsibility for damage caused by items imported without permission. Our guest bears full legal and financial responsibility for any damage or injury caused by items brought in without the permission of other guests, third parties or the hotel.

 

14. Smoking

 

Non-smoking rooms.

 

Accordingly, smoking and the use of electronic cigarettes are prohibited in closed apartment rooms (including guest rooms) and common areas, with the exception of designated smoking areas.

Apartment employees have the right to warn guests and any other persons on the territory of the apartment about the need to comply with this rule and stop smoking and smoking electronic cigarettes. Our guests, as well as any person residing on the premises, are required to abide by the rules and comply with any notices. If, due to the illegal behavior of any guest or other person residing on the territory of the apartment, the apartment is fined by the competent authority on the basis of the relevant legislation, the apartment has the right to transfer the amount of the fine to the person who demonstrated the violation of illegal behavior.

 

15. Illness or death of a guest

 

15.1. If our guest falls ill while using the accommodation service and is unable to take care of himself, the apartment offers medical assistance. Our guest uses the medical assistance offered at his own risk. The physician is not an employee, agent or investor of the property, and the property disclaims responsibility for the diagnosis, therapy administered and its consequences.

15.2. In the event of illness/death of our guest, the apartment requires reimbursement of expenses from the relatives of the sick/deceased person, heirs or payer; regarding possible medical and procedural expenses, compensation for services used before death, and possible damage to equipment and furnishings due to illness/death.

15.3. In the event of an infectious disease of our guest, the apartment has the right to terminate the apartment agreement with immediate effect without refund or compensation. In this case, the guest must leave the apartment with his luggage at his own expense within the period specified in the apartment's cancellation notice. In the event of an infectious disease, the apartment is subject to Law 18/1998. (VI. 3.) The NM is obliged to act in accordance with the decree. (The regulations prescribe what needs to be done in case of an infectious disease. According to the regulations, if there is such a suspicion, the apartment calls a doctor, and he determines whether the guest is contagious or not.)

 

16. Found items

 

Please return any found items to the front desk, where they will be registered. The apartment destroys food, food and medicine. The apartment contains items that can be stored for 3 months. If the rightful owner of the found item comes forward, he can receive the item by presenting and signing a document proving his identity. Items that can be shipped by mail will be returned to their owner by mail upon request (upon prepayment of shipping costs).

 

17. Hotel liability for damage

 

 

We would like to draw the attention of our dear guests to the fact that our apartment is not responsible for valuables left in the room. Please put valuables in the safe in your room! In case of placing larger valuables, the central safe located at the reception of our apartments is at your disposal free of charge.

 Our guest uses and uses the apartment's equipment, wellness and other services for their intended purpose, with awareness and knowledge of their health, physical and mental condition, therefore we are not responsible for damage resulting from use or misuse or in accordance with actual health , physical and mental condition of the guest, the apartment declines responsibility.

 

 

 

 

 

18. Refusal to fulfill the contract, termination of service obligation

 

18.1. The service provider has the right to terminate the Agreement for the provision of accommodation services with immediate effect, thereby refusing to provide services, if:

18.1.1. The guest does not use the room or facility for its intended purpose

18.1.2. The guest behaves disrespectfully and rudely to the security and order of the accommodation facility, its employees, is under the influence of alcohol or drugs, displays threatening, offensive or other unacceptable behavior

18.1.3. The guest is suffering from an infectious disease.

18.1.4. The Contracting Party fails to fulfill its obligation to pay the deposit specified in the Agreement by the specified date

18.2. In the event of failure to fulfill the Agreement between the parties due to “force majeure”, the Agreement will be terminated.

 

19. Placement Guarantee

 

19.1. If the Service Provider is unable to provide the services included in the Agreement due to his own fault (for example, overcharging, temporary problems in work, etc.), then he is obliged to immediately arrange accommodation for the Guest.

19.1.1. The service provider is obliged:

19.1.1.1. provide/offer the services included in the Agreement, at the price confirmed therein, for the period specified therein - or until the obstacle is removed - in another accommodation facility of the same or higher category. All additional costs for providing replacement accommodation on the premises of the Apartment are borne by the service provider.

19.1.1.2. provide the Guest with the opportunity to make a free call to inform about changes in accommodation

19.1.1.3. provide the Guest with a free transfer to check into the proposed alternative accommodation, and later back

19.1.2. If the Contractor fulfills these obligations in full or the Guest accepts the alternative accommodation option offered to him, the Contracting Party does not have the right to make a subsequent claim for damages.

 

20. Rights of the Contracting Party

 

20.1. In accordance with the Agreement, the Guest has the right to the intended use of the ordered room and accommodation facilities, which are included in the standard set of services and are not subject to special conditions.

20.2. A guest may file a complaint regarding the performance of services provided by the service provider while staying at the property. During this period, the Service Provider undertakes to consider complaints sent to it with written confirmation (or recorded by it in the protocol).

20.3. The Guest's right to complain ends upon departure from the accommodation facility.

 

21. Obligations of the Contracting Party

 

 

21.1. The Contracting Party undertakes to pay for the services ordered under the Agreement within the time limits and in the manner specified in the Agreement.

21.2. The Guest guarantees that a child under 18 years of age who is under his responsibility is at the Service Provider's accommodation only under the supervision of an adult.

 

22. Service Provider Rights

 

In case of failure by the Guest to fulfill the obligation to pay for services used or ordered under the Agreement, but not used, penalties, the Service Provider has the right to retain the Guest’s personal belongings, which he brought with him to the hotel in order to ensure his requirements.

 

23. Responsibilities of the Service Provider

 

The service provider is obliged:

 

23.1. carry out orders for accommodation and other services under the contract in accordance with current regulations and service standards

23.2. study the guest's written complaint and take the necessary measures to resolve the problem, which must also be recorded in writing

 

24. Liability of the Service Provider for damages

 

24.1. The Service Provider assumes responsibility for any damage to the Guest that occurs at its facilities due to the fault of the Service Provider or its employees.

24.2. The Service Provider's liability does not apply to damage caused by unavoidable causes beyond the control of employees and guests of the accommodation, or caused by the guest himself.

24.3. The service provider may designate areas in the hotel where the Guest has no right to enter. The service provider is not responsible for any damage or injury that may occur in such locations.

24.4. Guest must immediately report damage to online customer service and provide the hotel with all necessary information to determine the circumstances of the damage or complete a police report/procedure.

24.5. The service provider is not responsible for valuables, securities and funds.

24.6. The service provider is not responsible for personal items left in common areas or premises of the property (including items placed in the room safe).

24.7. The service provider is not responsible for valuables left in a vehicle in a closed parking lot, and will also investigate damage to parked vehicles and, if the damage is caused by the guest's negligence, the guest will reimburse it in full..

24.8. The upper limit of the amount of compensation is fifty times the daily cost of the room according to the Agreement, if the damage is not less than this amount.

 

25. Protection of consumer interests, data protection

 

25.1. In the course of its activities, the Service Provider attaches great importance to the protection of personal data. In all cases, it processes the personal data provided to it in accordance with applicable law, ensures its security, takes technical and organizational measures and develops procedural rules necessary to comply with relevant laws.

25.2. The service provider summarizes its guidelines regarding data management in a separate Data Protection Policy, which is permanently available on the website: https://www.mmapartment.biz/ and the contents of which it is bound by. The Data Protection Regulation also contains information on the management of individual data.

25.3. Over the activities of the service provider, the Budapest District Consumer Protection Inspectorate exercises professional supervisory rights.

 

26. Force Majeure

 

Force majeure is a cause or circumstance (for example, war, fire, flood, bad weather, power outages, strike) over which a party has no control (force majeure), either party is released from fulfilling its obligations arising from the Agreement, until that cause or condition exists. The parties agree that they will use their best efforts to minimize the occurrence of these causes and circumstances and to remedy any damage or delay caused as soon as possible.

 

27. Applicable law in legal relations between the parties, court

 

The legal relationship between the Service Provider and the Contracting Party is governed by the provisions of the Hungarian Civil Code. Any legal disputes arising from the contract for the provision of services are resolved by the court at the place of registration of the accommodation facility.. ,
